RFP and FOIPPA

After completing a request for proposal process for some engineering to fulfil some grant funded work, I received a request for all submissions and the documents relating to the review of the submission. I think this information is not public. Am I correct?

  • Section 21 of FOIPPA requires that you withhold any information that disclosure would be harmful to business interests of a third party. Proposals likely contain information that could hurt a business interests and were provided to you with the expectation of confidentiality.

Our policy is that if asked we will provide a summary of who provided a proposal and their total scores but no further details than that.
